How do I check title, and what is family land?

Never buy Saint Lucia land without a Land Registry search and a surveyor's plan check, run by your own attorney. The register, not any paper the seller shows you, is what ownership means here. Family land, co-owned by generations of relatives, is the island's classic trap: one branch cannot sell what all branches own.

The title check, step by step

  1. Instruct your own attorney. Not the seller's, not the agent's. Every later step runs through them.
  2. Land Registry search. Saint Lucia runs a registered-parcel system under the Land Registration Act; the Registry (ground floor, Graham Louisy Administrative Building, Waterfront, Castries) produces the official record of the parcel: who owns it and every registered charge, caution and encumbrance on it.
  3. Survey plan against the cadastral map. A licensed land surveyor's plan must match the parcel's cadastral reference from the island-wide survey. Boundaries on the ground, on the plan and on the register must agree before money moves.
  4. Only then, deposit into escrow through the attorney. Completion registers the transfer at the Registry; unregistered paper is not ownership.

Family land, plainly

"Family land" is land co-owned by many relatives at once, usually because it passed for generations without wills: each death spread ownership across every child in equal shares. The documented problems: co-owners often hold no paper at all, no single person can sell or mortgage without the others, and a purchase from one branch of the family does not bind the rest. It is why some beautiful parcels are cheap and stay cheap.

Red flags: walk away or slow down

  • The seller cannot produce a registered title in their own name, only "the family agrees".
  • Any pressure to pay the seller or the agent directly, in cash, before your attorney completes.
  • Documents that cannot be matched at the Registry: assume fakes exist, because they do.
  • A survey plan that does not match the cadastral reference, or no plan at all.
  • A price dramatically below the district median with no stated reason: cheap usually has a title-shaped cause.
